    Hi,

    I have leased a DS3 which unfortunately got written off earlier this week.
    I read the follwoing thread however it does not cover the situation I am currently in:

    Unfortunately my partner who drove it only has third party fire and theft.
    I know, I know...I should not have let him drive the car. You live and you learn, albeit a very expensive way to learn.

    The car was due to be handed back in early may, hence I was about to pay for the last month of my lease.
    However, what do I do now?
    The car is currently at a yard somewhere and under normal circumstances I believe the insurance company would have gone to assess it; who should be doing the assessment now?

    I am yet to let my lease company know which I will be doing later today.
    My concern is, how do I know i will get a fair valuation?
    I am concerned they will tell me that it is worth 10K when really perhaps it would only have been worth 8K

    Should I be getting my own insurance company involved?

    Your help is much appreciated.

    First things first, contact the yard where the car is being held and arrange to move it. You'll be billed at a daily rate for the length of time the car is there and this can quickly add up!

    I think it's probably worth reviewing the text in both your lease agreement and your insurance agreement. One, if not both of these should hopefully cover what to do in the event of a situation like this.

      Welcome - albeit under nasty circumstances!

      Sorry to hear about your situation, hope everyone was ok after the write off. I'm sure someone will have some help and advice for you.

        Really sorry to hear this.....

        As Liam said, what does your lease car agreement say about this ? Also does it stipulate who can drive the car ? Do you have a family solicitor ? It might be worth discussing it with them to see if they can help you...

            The situation is a simple one really, the car was involved in an accident while your partner was driving. Because he insurance cover did not provide full cover then you are liable to the lease company the value of the car. In this case the lease company will instruct their insurance agents to administer the car and it will be this agent who will put the value on the vehicle. It might be worth speaking with your own insurance company but I doubt that they will get involved because your partner was not their listed driver. Agree with Fish I would recommend having the vehicle moved (as agreed with the lease company) to avoid any heavy storage charges.

            The other concern I have in my mind is that you may have breached the terms of your contract by allowing your partner to drive,which unfortunately will open a whole cans of worms and could put you in a very weak position. The lease company would be in their right to sue you for all damages and costs.

            All I can say is let this be a lesson to all members on this club about the perils of "Third Party Clause" when someone else drives your car...

              Not a lot of sympathy I am afraid- you even know the other person should not have driven

                Was it a talent malfunction job eg driving into the ditch or middle of a roundabout, or was another party involved who caused or partly caused the accident, just in case there is an option for the insurance to pay out from the other party?
