At what point is the VIN number issued?

Having cancelled my original order of 8th October last week (expected delivery 10th December) and placed a new order on 28th October, I have today received a confirmation of registration details sheet from the new dealer which shows a VIN number.

Does this mean that I shouldn't have too long to wait to receive my DS3?

A VIN is issued at the factory once the vehicle is constructed. What it means to you is that the order is physical.

Unfortunately I did lose my original deposit, but as I was never given a copy of the full T&C's, which I have now requested, I am going to try and see if I can get some of this back, as I have been advised that for a Breach of Contract the injured party can only claim compensation for actual losses incurred, which would need to be substantiated.

Never received a VIN on the original order so assume that it hasn't been constructed yet.

Tricky one, this. If they can sell every DS3 that they can get their hands on (i.e. if demand exceeds supply), you should be OK, as there is what contract lawyers call an "available market" for the goods, & so they won't have lost any profit on the deal (assuming they can sell it at the same price you agreed to pay). However, if they can show that they've actually lost a sale (i.e. if supply exceeds demand), they could come after you for their lost profit, or, more likely, refuse to refund your deposit, which might be seen as a genuine pre-estimate of their loss in the event of the sale falling through (& therefore lawful), rather than as a penalty pure & simple (and therefore unlawful).

I don't think there is going to be a problem with supply exceeding demand and as he originally gave me a larger than normal discount, I should think that he would get a better sale at the end of the day.
