But the dealer will not accept the rejection or give me my money back.
His words were 'im not prepared to lose thousands of pounds on your vehicle which is now used goods'
So?
He can say what he wants, it doesn't change the law. Once you physically leave the car there, its been rejected. If you drive off with it you haven't rejected it.
Not sure why new tyres were being fitted. Did you specify a change of wheels?
Speak with CUK customer service who will try to redirect you to the dealer, but you must try and be resolute and insist that the dealer is not working in your interests. The dealer does not want to take your car back and will do everything to avoid doing so. Notify the finance company and tell them that their goods are of unmerchantable quality, that the dealer has been given reasonable opportunity to repair the vehicle but have not succeeded and that you do not wish to be refunded but to have a replacement and the finance agreement substituted - i.e. transferred to the replacement vehicle. They can do this.
All the while this is going on the dealership (if they have the car still) will be trying to fix it so that they can say that there was a fault, it has been fixed under the terms of the warranty and that you have no grounds for rejection. If you are still driving the car they will put forward the same argument, i.e you are driving it so it must be acceptable.
