  • Wheelchair user crashes into my car and doesn't even apologise!

So I'm going to pick up my dad from the hospital today and in waiting to turn left to enter the hospital car park. I'm completely stationary but somehow a man driving a mobility scooter manages to crash his chair into the front of the car. I'm not exaggerating when I say crash because he actually had to reverse his scooter to keep crossing the road. What happened next I still can't really believe. The man simply reverses and keeps on driving as if nothing has happened. I have only had this car for a month and it was up until now scratch/dent free so when I got out to look at where he hit me there was a deep 4-5 inch scratch next to various scuff marks. I ask him to come back and he didn't even turn around to acknowledge me! I had to jog down the road to catch him and when I did he stops and tells me he's late for his appointment and hasn't got time to stop and look at the car. At this point a pedestrian joins in and tells me to let him go because he's in a wheelchair. I'm sorry but whether you're a wheelchair user, a cyclist or even a blind person with a stick, if you hit something and damage it the bare minimum is surely an apology? I took down his details but I'm unsure what I can even do with them to be fair. Just very frustrated.

That's not acceptable is it ?

I'd report it to the hospital and see if they have any CCTV that can be used to show the incident and the damage caused to your car. I'd then be inclined to report it to the local police station on the non emergency line and explain what happened and when and provide any other details that are relevant.

It might also be worthwhile telling your insurance Co what happened and providing the details to them, explaining what you have done so far in reporting this and seeing if they have any suggestions.

I hope you get this sorted as motability scooter users shouldn't be exempt from the damage they cause, problem is I don't think they have to have insurance do they ?

A similar thing happened to me with a cyclist attempting to text and ride at the same time. He panicked cycling along the side of my car and took the sharp end of his handlebars to the car and scratched the vinyl off.

Went to the local police station after escorting the kid back to his parents (both whom didn't speak a word of English) and was advised that it wasn't a police matter -_-

It may be a mobility scooter but if they have the right to drive it on the road then surely it's classed as a vehicle on the road. I know when a push bike hit my colleagues parked car (he wasn't looking up) he had to claim it through the cylists house insurance so maybe same can be done in this matter...

A hospital staff member who recognised him said he was an obnoxious/rude character, it was the audacity of the guy that shocked me to be fair. As for the damage I'm going to have to get some scratch remover or matching paint to sort it out.

            http://www.recare.co.uk/html/scooters_on_roads.html

This gives a little heresay type information that might help, it would be good if you knew which class of scooter it was too It appears that insurance is recommended but not a requirement however.

I doubt it would be considered a vehicle, he was using it on the pavement and crashed into the car when he was crossing the road.

I don't know how to tell the difference between the two classes, they obviously differ in speed etc but not sure how visible that would be ?

It looked like a really bulky chair and was pretty fast considering I had to jog to catch him down the road. Didn't see anything like a tax disc which covers class 3 scooters though.

Yeah the Class 3's appear to have a higher top speed and you need to apply for a tax exempt disc I think...

If you have his details I'd contact your insurer and see if they can advise Good luck

You should report it at the police station, giving the man and address of the gentleman which the hospital should be able to give you. If not then let the police know that the hospital know who the gentleman was.

If you make a claim you will most likely have to pay your excess when using the insurance as it's unlikely that the scooter was covered by any policy. The crux of that is you will end up losing your NCD.

The other option would be to seek damages through the small claims court but that might be more hassle then it's worth.

I'd have booted him off, jumped on the scooter and drove into his head repeatedly while shouting at him to move because "I'm late for my appointment"
