Recently watched a debate where Jacob Rees-Mogg (Favourite MP) debunked this. I've linked to the exact point in the debate for easy reference:

it's a hell of an understatement the black speaker (I don't know his name) gives there : "I'm not saying the EU is on a perfect good job at the immigration issue..."
rigth now the EU is doing a really shitty job on this issue. There is no working together. Everyone is on its own.
The unity got lost at the moment. This has to be changed.

The NHS is totally unworkable, the system needs to change and bring itself up to the modern age. There is not a single country that can afford a free health service.

We need to look at other countries and they way they run their health services, there needs to be an initial fee that can, if warranted, be claimed back. We need to stop A&E being swamped by pointless calls and visits, if people had to pay to arrive with a broke fingernail they would think again.

Yes, but immigration isn't really "important" to many. It makes little difference to most. There are far more factors that will effect everyone in their day to day life. But these are forgotten because people want to stop immigration, which will never happen, in or out of the EU.

I beg to differ. If it wasn't such a key issue to a lot of people why is it discussed so fervently?

Because its a safe haven of debate for the Leave campaign, much like the economy is for the Stay. When a debate gets a little wobbly, always return to a safe topic, ie immigration and the economy.

Leaving the EU will have a negligible effect on immigration, over 50% come from outside the EU and our border security have failed to address that issue, yes the ECHR is a hugely limiting factor when it comes to enforcing various laws concerning border control but as they are a seperate entity from the EU, leaving will have zero impact there either.

I'm only just reading up on this now - I wasn't aware of the ECHR being used to walk around expulsion from the UK till now.

Wouldn't the counter argument to this be that if we left the EU we could then draft our own human rights act to counter the loopholes in current legislation? Or am I just being naive?

You can't deny that the greek letter has some points.

Making your own CHR won't be so easy as UK has signed the UN Universal Declaration of Human Rights which is also the basis for the ECHR.

In an ideal world we leave the ECHR and draw up a UK Bill of Rights, but we must be out of the EU to do that.

Still learning more about this - What sort of issues do those using the HR Act raise as a reason for them not being expelled?
