  • Should I just pay

    I got a text from my driving instructor to say I have to pay him £65 for a fine he says I incurred from driving in a bus lane last week.

    He's paid it, but I should reimburse him. The annoying thing is I have seen no evidence to say that I even did it. If I have I will pay but as he has now paid it I have no way of contesting it.

    What do you guys reckon?

    If he was instructing you at the time, he was legally in charge, so should take the fine himself

      As above - if you should not have driven in the bus lane then he should have made you aware - would he not tell you if you went up a one way street the wrong way ? Your the learner an he the instructor

        That's what I thought, isn't there a driving instructor on this forum. Be great to get his opinion, anybody know there username

          But you know what an Instructors gonna say
          Email your person and ask them why you have to pay it whilst they were legally in charge

            Best thing is to take legal advice but I would have thought the instructor is at fault for not making you aware at the time of the bus lane. Even if he knew you were in the bus lane at the time he should have told you then. Does not sound like a good driving instructor in the first place.

              Don't pay. By paying you are losing any right of appeal. He should have consulted you before he paid to see if you wanted to challenge it.

                Arguably, its down to you because you were driving. If you were clocked doing 40 in a 30 limit, you not the instructor would get the fine and points.

                    Both of you are at fault. As a learner you and the instructor are classed as driving. But if hes paid it dont worry.

                      As a former driving instructor I can confirm that the instructor is responsible for what happens
                      in the car, so if you drove in a bus lane he is responsible. If you were caught speeding/ going through red light he would
                      also be responsible.
                      This is the whole point of learning with an instructor, if he allows you to do something that is illegal then he must suffer
                      the consequences. I would advise you under no circumstances should you part with any cash.

                          Phil,

                          I am a Driving Instructor, and unfortunately it's the drivers responsibility to pay fines, get points etc.
                          The Instructor can at the most be done for aiding and abeting.
                          However, this should not have happened, your instructor should have told you straight away not to go into Bus Lane, same as if you were speeding he should tell you straight away.
                          As Instructors we have dual controls and also we often have to reach for the steering wheel, so if telling a learner doesn't work, we physically take action.
                          If I was your instructor i would blame myself and pay the fine as long as there are no points involed, as legally it has to be the driver who gets the points, regardless of experience etc, wheras anyone can pay a fine.
                          If i were you i would say to your instructor, why didn't you tell me i was driving in a bus lane?
                          Hopefully he will do the right thing and not ask you for the money.

                            surely it could be contested as it was a general accident that ya was in the bus lane and there must be some leway as taxi's n bikes can use em n im i drifted into 1 2wkks ago got nowt but then ad no choice as there was a bunch of funeral cars parked up on other side of the road also wether you was causing an obstruction ie parked up then thats good grounds for a ticket but if it was a mistake then id contest it n get it thrown out
